Or, si la loi du 24\u00a0ao\u00fbt 2021 confortant le respect des principes de la R\u00e9publique<span class=\"footnote_referrer\"><a tabindex=\"0\" role=\"button\"><sup id=\"footnote_plugin_tooltip_901105038_1_2\" class=\"footnote_plugin_tooltip_text\">[2]<\/sup><\/a><\/span>\u00a0a renforc\u00e9 les possibilit\u00e9s du Gouvernement en mati\u00e8re de dissolution administrative, il est important de rappeler que c\u2019est toujours la libert\u00e9 d\u2019association qui continue de pr\u00e9dominer dans l\u2019ordre juridique fran\u00e7ais.<\/strong><\/p>\n<p>La libert\u00e9 d\u2019association a \u00e9t\u00e9 promue au rang des principes fondamentaux reconnus par la loi de la R\u00e9publique depuis une d\u00e9cision du Conseil constitutionnel en date du 16\u00a0juillet 1971<span class=\"footnote_referrer\"><a tabindex=\"0\" role=\"button\"><sup id=\"footnote_plugin_tooltip_901105038_1_3\" class=\"footnote_plugin_tooltip_text\">[3]<\/sup><\/a><\/span>. Depuis lors, toute restriction apport\u00e9e \u00e0 cette libert\u00e9 ne peut \u00e9maner que du l\u00e9gislateur qui, r\u00e9cemment, a souhait\u00e9 adapter le r\u00e9gime de dissolution administrative \u00e0 un contexte qu\u2019il juge nouveau.<\/p>\n<h3><\/h3>\n<h3><strong>R\u00e9gime juridique applicable en mati\u00e8re de dissolution administrative<\/strong><\/h3>\n<p>&nbsp;<\/p>\n<p><strong>La libert\u00e9 d\u2019association, comme principe<\/strong><\/p>\n<p>La d\u00e9cision du 16\u00a0juillet 1971 \u2013 consid\u00e9r\u00e9e comme l\u2019une des plus importantes prises par le Conseil constitutionnel ces derni\u00e8res ann\u00e9es \u2013 consacre la libert\u00e9 pour l\u2019association de se d\u00e9velopper et d\u2019exercer librement l\u2019activit\u00e9 qu\u2019elle a choisie<span class=\"footnote_referrer\"><a tabindex=\"0\" role=\"button\"><sup id=\"footnote_plugin_tooltip_901105038_1_4\" class=\"footnote_plugin_tooltip_text\">[4]<\/sup><\/a><\/span>. La libert\u00e9 d\u2019association est alors appr\u00e9hend\u00e9e comme une libert\u00e9 \u00ab\u00a0collective\u00a0\u00bb. En effet, pour le Conseil constitutionnel, il s\u2019agit avant tout de prot\u00e9ger la libert\u00e9 des citoyens de s\u2019exprimer \u2013 sous une forme collective organis\u00e9e \u2013 contre toute atteinte arbitraire de la puissance publique.<\/p>\n<p>La libert\u00e9 d\u2019association a \u00e9galement \u00e9t\u00e9 consacr\u00e9e dans l\u2019ordre juridique europ\u00e9en par l\u2019article 11 de la Convention de sauvegarde des droits de l\u2019homme et des libert\u00e9s fondamentales. D\u00e8s lors, elle fait d\u00e9sormais partie des principes fondamentaux prot\u00e9g\u00e9s par la jurisprudence constante de la Cour de justice de communaut\u00e9s europ\u00e9ennes \u2013 aujourd\u2019hui devenue Cour de justice de l\u2019Union europ\u00e9enne \u2013 tout en \u00e9tant, par ailleurs, \u00ab\u00a0<em>r\u00e9affirm\u00e9e par le pr\u00e9ambule de l\u2019Acte unique europ\u00e9en et par l\u2019article F, paragraphe\u00a02, du trait\u00e9 sur l\u2019Union europ\u00e9enne<\/em>\u00a0\u00bb<span class=\"footnote_referrer\"><a tabindex=\"0\" role=\"button\"><sup id=\"footnote_plugin_tooltip_901105038_1_5\" class=\"footnote_plugin_tooltip_text\">[5]<\/sup><\/a><\/span>. Ainsi, a pu \u00eatre jug\u00e9 sur le fondement de ces dispositions, notamment que la libert\u00e9 d\u2019association garantit \u00ab\u00a0<em>la possibilit\u00e9 pour les individus de partager leurs convictions ou leurs id\u00e9es collectivement, en particulier dans le cadre d\u2019associations d\u2019individus ayant les m\u00eames convictions, id\u00e9es ou int\u00e9r\u00eats<\/em>\u00a0\u00bb<span class=\"footnote_referrer\"><a tabindex=\"0\" role=\"button\"><sup id=\"footnote_plugin_tooltip_901105038_1_6\" class=\"footnote_plugin_tooltip_text\">[6]<\/sup><\/a><\/span>.<\/p>\n<p>Dans l\u2019ordre juridique international, la libert\u00e9 d\u2019association est reconnue par le Pacte international relatif aux droits civils et politiques du 19\u00a0d\u00e9cembre 1966 dans son article\u00a022\u00a0: \u00ab\u00a0<em>1. Toute personne a le droit de s\u2019associer librement avec d\u2019autres, y compris le droit de constituer des syndicats et d\u2019y adh\u00e9rer pour la protection de ses int\u00e9r\u00eats. 2.\u00a0L\u2019exercice de ce droit ne peut faire l\u2019objet que des seules restrictions pr\u00e9vues par la loi et qui sont n\u00e9cessaires dans une soci\u00e9t\u00e9 d\u00e9mocratique, dans l\u2019int\u00e9r\u00eat de la s\u00e9curit\u00e9 nationale, de la s\u00fbret\u00e9 publique, de l\u2019ordre public, ou pour prot\u00e9ger la sant\u00e9 ou la moralit\u00e9 publiques ou les droits et les libert\u00e9s d\u2019autrui. Le pr\u00e9sent article n\u2019emp\u00eache pas de soumettre \u00e0 des restrictions l\u00e9gales l\u2019exercice de ce droit par les membres des forces arm\u00e9es et de la police.\u00a0<\/em>\u00bb<\/p>\n<p>\u00c9lev\u00e9e au rang de principe \u00ab\u00a0\u00e0 valeur constitutionnelle\u00a0\u00bb solennellement r\u00e9affirm\u00e9 par le pr\u00e9ambule de la Constitution<span class=\"footnote_referrer\"><a tabindex=\"0\" role=\"button\"><sup id=\"footnote_plugin_tooltip_901105038_1_7\" class=\"footnote_plugin_tooltip_text\">[7]<\/sup><\/a><\/span>, la libert\u00e9 association emp\u00eache les autorit\u00e9s administratives de soumettre la constitution d\u2019une association \u00e0 un contr\u00f4le pr\u00e9alable, d\u2019exercer leur tutelle ou des contraintes en dehors des limites impos\u00e9es par la loi<span class=\"footnote_referrer\"><a tabindex=\"0\" role=\"button\"><sup id=\"footnote_plugin_tooltip_901105038_1_8\" class=\"footnote_plugin_tooltip_text\">[8]<\/sup><\/a><\/span>, ou encore d\u2019\u00e9dicter des mesures restrictives susceptibles d\u2019entra\u00eener des discriminations entre associations poursuivant un objet identique dans des conditions similaires<span class=\"footnote_referrer\"><a tabindex=\"0\" role=\"button\"><sup id=\"footnote_plugin_tooltip_901105038_1_9\" class=\"footnote_plugin_tooltip_text\">[9]<\/sup><\/a><\/span>.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Dissolution administrative, un cadre l\u00e9gal d\u2019exception<\/strong><\/p>\n<p>La libert\u00e9 d\u2019association n\u2019est toutefois pas absolue. Elle ne saurait \u00eatre utilis\u00e9e pour mettre en danger les institutions de l\u2019\u00c9tat ou porter atteinte aux droits et libert\u00e9s d\u2019autrui. Ainsi, la dissolution administrative d\u2019une association ayant pour but de d\u00e9truire les id\u00e9aux et valeurs d\u2019une soci\u00e9t\u00e9 d\u00e9mocratique, si elle est une mesure radicale, correspond \u00e0 \u00ab\u00a0<em>un besoin social imp\u00e9rieux<\/em>\u00a0\u00bb et poursuit un \u00ab\u00a0<em>but l\u00e9gitime<\/em>\u00a0\u00bb<span class=\"footnote_referrer\"><a tabindex=\"0\" role=\"button\"><sup id=\"footnote_plugin_tooltip_901105038_1_10\" class=\"footnote_plugin_tooltip_text\">[10]<\/sup><\/a><\/span>.<\/p>\n<p>Dans ces situations, la dissolution d\u2019une ou plusieurs associations peut r\u00e9sulter, soit d\u2019une loi \u2013 tel est le cas, par exemple, pour l\u2019association \u00ab\u00a0Action Logement Groupe\u00a0\u00bb<span class=\"footnote_referrer\"><a tabindex=\"0\" role=\"button\"><sup id=\"footnote_plugin_tooltip_901105038_1_11\" class=\"footnote_plugin_tooltip_text\">[11]<\/sup><\/a><\/span>\u00a0\u2013 soit d\u2019un d\u00e9cret pris en conseil des ministres<span class=\"footnote_referrer\"><a tabindex=\"0\" role=\"button\"><sup id=\"footnote_plugin_tooltip_901105038_1_12\" class=\"footnote_plugin_tooltip_text\">[12]<\/sup><\/a><\/span>. Cette derni\u00e8re proc\u00e9dure a r\u00e9guli\u00e8rement \u00e9t\u00e9 mise en \u0153uvre par les derniers gouvernements successifs, notamment \u00e0 l\u2019encontre d\u2019associations de hooligans, de groupes de combat, milices priv\u00e9es ou encore d\u2019associations se livrant \u00e0 des actes terroristes\u2026<\/p>\n<p>Les derniers exemples en date concernent la dissolution administrative de l\u2019association \u00ab\u00a0G\u00e9n\u00e9ration identitaire\u00a0\u00bb, ce groupuscule \u00e0 qui il avait \u00e9t\u00e9 reproch\u00e9 de promouvoir \u00ab\u00a0<em>une id\u00e9ologie provoquant \u00e0 la haine, \u00e0 la violence et \u00e0 la discrimination des individus \u00e0 raison de leur origine, de leur race ou de leur religion, et sur ce qu\u2019elle employait dans sa communication comme dans son organisation, une symbolique et une rh\u00e9torique martiales, l\u2019identifiant implicitement ou explicitement \u00e0 une formation paramilitaire<\/em>\u00a0\u00bb<span class=\"footnote_referrer\"><a tabindex=\"0\" role=\"button\"><sup id=\"footnote_plugin_tooltip_901105038_1_13\" class=\"footnote_plugin_tooltip_text\">[13]<\/sup><\/a><\/span>. Autre exemple en date, celui beaucoup plus controvers\u00e9<span class=\"footnote_referrer\"><a tabindex=\"0\" role=\"button\"><sup id=\"footnote_plugin_tooltip_901105038_1_14\" class=\"footnote_plugin_tooltip_text\">[14]<\/sup><\/a><\/span>\u00a0du Collectif contre l\u2019Islamophobie en France (CCIF), une association qui avait pourtant comme objet de combattre par les voies de droit les discriminations dont sont victimes les personnes musulmanes. Et dont, curieusement, on ne retrouve aucune trace de l\u2019arr\u00eat rendu \u00e0 son encontre par le Conseil d\u2019\u00c9tat le 24\u00a0septembre 2021. Ni sur L\u00e9gifrance, ni sur le site du Conseil d\u2019\u00c9tat<span class=\"footnote_referrer\"><a tabindex=\"0\" role=\"button\"><sup id=\"footnote_plugin_tooltip_901105038_1_15\" class=\"footnote_plugin_tooltip_text\">[15]<\/sup><\/a><\/span>\u2026<\/p>\n<p>La proc\u00e9dure de dissolution administrative doit \u00eatre prononc\u00e9e dans les cas strictement pr\u00e9vus par la loi et seulement dans ces hypoth\u00e8ses<span class=\"footnote_referrer\"><a tabindex=\"0\" role=\"button\"><sup id=\"footnote_plugin_tooltip_901105038_1_16\" class=\"footnote_plugin_tooltip_text\">[16]<\/sup><\/a><\/span>. Or, c\u2019est pr\u00e9cis\u00e9ment sur ces \u00ab\u00a0cas\u00a0\u00bb que s\u2019est r\u00e9cemment pench\u00e9 le l\u00e9gislateur \u00e0 l\u2019occasion de la loi du 24\u00a0ao\u00fbt 2021<span class=\"footnote_referrer\"><a tabindex=\"0\" role=\"button\"><sup id=\"footnote_plugin_tooltip_901105038_1_17\" class=\"footnote_plugin_tooltip_text\">[17]<\/sup><\/a><\/span>.<\/p>\n<p>&nbsp;<\/p>\n<h3><strong>Apports de la loi du 24 ao\u00fbt 2021<\/strong><\/h3>\n<p>L\u2019article 16 de la loi confortant le respect des principes de la R\u00e9publique a apport\u00e9 quelques pr\u00e9cisions aux motifs de dissolution pr\u00e9vus \u00e0 l\u2019article L. 212-1 du code de la s\u00e9curit\u00e9 int\u00e9rieure en rempla\u00e7ant, notamment, la provocation aux \u00ab\u00a0manifestations arm\u00e9es dans la rue\u00a0\u00bb, par celle concernant les \u00ab\u00a0manifestations arm\u00e9es\u00a0\u00bb ou \u00ab\u00a0agissements violents \u00e0 l\u2019encontre des personnes ou des biens\u00a0\u00bb. Il en est de m\u00eame, s\u2019agissant des associations ou groupements de fait ayant \u00ab\u00a0pour but de porter atteinte \u00e0 l\u2019int\u00e9grit\u00e9 du territoire ou d\u2019attenter par la force \u00e0 la forme r\u00e9publicaine du Gouvernement\u00a0\u00bb, avec des dispositions qui, d\u00e9sormais, ne concernent pas uniquement leur \u00ab\u00a0objet\u00a0\u00bb mais \u00e9galement leur \u00ab\u00a0action\u00a0\u00bb.<\/p>\n<p>Dans cet objectif, la loi du 24\u00a0ao\u00fbt 2021 permet aussi de dissoudre une association \u00e0 raison des provocations ou agissements illicites<span class=\"footnote_referrer\"><a tabindex=\"0\" role=\"button\"><sup id=\"footnote_plugin_tooltip_901105038_1_18\" class=\"footnote_plugin_tooltip_text\">[18]<\/sup><\/a><\/span>\u00a0de l\u2019un ou plusieurs de ses membres, soit m\u00eame lorsque ces derniers \u00ab\u00a0propagent des id\u00e9es ou des th\u00e9ories tendant \u00e0 justifier ou encourager\u00a0\u00bb ces m\u00eames agissements, d\u00e8s lors que leurs dirigeants, bien qu\u2019inform\u00e9s, se sont abstenus de prendre les mesures n\u00e9cessaires pour les faire cesser, compte tenu des moyens dont ils disposent<span class=\"footnote_referrer\"><a tabindex=\"0\" role=\"button\"><sup id=\"footnote_plugin_tooltip_901105038_1_19\" class=\"footnote_plugin_tooltip_text\">[19]<\/sup><\/a><\/span>. D\u00e9sormais, les dirigeants reconnus d\u2019un groupe de combat pourront \u00e9galement \u00eatre interdits de diriger ou d\u2019administrer une association pendant une dure de trois ans \u00e0 compter de la date \u00e0 laquelle leur condamnation est devenue d\u00e9finitive, prononc\u00e9es sur la base des dispositions des articles L.\u00a0431-13 et suivants du code p\u00e9nal consacr\u00e9s aux groupes de combat ou mouvements dissous<span class=\"footnote_referrer\"><a tabindex=\"0\" role=\"button\"><sup id=\"footnote_plugin_tooltip_901105038_1_20\" class=\"footnote_plugin_tooltip_text\">[20]<\/sup><\/a><\/span>.<\/p>\n<p>Destin\u00e9e \u00e0 r\u00e9pondre \u00e0 certains \u00e9v\u00e9nements auxquels le Gouvernement a cru bon de devoir r\u00e9agir, cette loi du 24\u00a0ao\u00fbt 2021 visait initialement \u00e0 \u00ab\u00a0lutter contre le s\u00e9paratisme et les atteintes \u00e0 la citoyennet\u00e9 [fran\u00e7aise]\u00a0\u00bb<span class=\"footnote_referrer\"><a tabindex=\"0\" role=\"button\"><sup id=\"footnote_plugin_tooltip_901105038_1_21\" class=\"footnote_plugin_tooltip_text\">[21]<\/sup><\/a><\/span>. D\u00e8s son origine, elle a toutefois suscit\u00e9 une vive controverse<span class=\"footnote_referrer\"><a tabindex=\"0\" role=\"button\"><sup id=\"footnote_plugin_tooltip_901105038_1_22\" class=\"footnote_plugin_tooltip_text\">[22]<\/sup><\/a><\/span>, au point que la Commission nationale consultative des droits de l\u2019homme (CNCDH) en France<span class=\"footnote_referrer\"><a tabindex=\"0\" role=\"button\"><sup id=\"footnote_plugin_tooltip_901105038_1_23\" class=\"footnote_plugin_tooltip_text\">[23]<\/sup><\/a><\/span>\u00a0ainsi que la Commission europ\u00e9enne<span class=\"footnote_referrer\"><a tabindex=\"0\" role=\"button\"><sup id=\"footnote_plugin_tooltip_901105038_1_24\" class=\"footnote_plugin_tooltip_text\">[24]<\/sup><\/a><\/span>\u00a0n\u2019ont pas h\u00e9sit\u00e9 \u00e0 faire part de leurs inqui\u00e9tudes pour les droits et les libert\u00e9s civiles. Les associations doivent donc savoir qu\u2019une proc\u00e9dure de dissolution administrative peut toujours faire l\u2019objet de contestation devant la juridiction de l\u2019ordre administratif<span class=\"footnote_referrer\"><a tabindex=\"0\" role=\"button\"><sup id=\"footnote_plugin_tooltip_901105038_1_25\" class=\"footnote_plugin_tooltip_text\">[25]<\/sup><\/a><\/span>.<\/p>\n<p>&nbsp;<\/p>\n<h4><strong>Contestation de la dissolution<\/strong><\/h4>\n<p>L\u2019association concern\u00e9e par la dissolution<span class=\"footnote_referrer\"><a tabindex=\"0\" role=\"button\"><sup id=\"footnote_plugin_tooltip_901105038_1_26\" class=\"footnote_plugin_tooltip_text\">[26]<\/sup><\/a><\/span>\u00a0voire l\u2019un de ses membres<span class=\"footnote_referrer\"><a tabindex=\"0\" role=\"button\"><sup id=\"footnote_plugin_tooltip_901105038_1_27\" class=\"footnote_plugin_tooltip_text\">[27]<\/sup><\/a><\/span>\u00a0peut d\u00e9f\u00e9rer au juge de l\u2019exc\u00e8s de pouvoir la d\u00e9cision pronon\u00e7ant sa dissolution. En effet, et bien que la dissolution soit prononc\u00e9e par d\u00e9cret, le recours en annulation doit \u00eatre form\u00e9 devant le tribunal administratif, tel que le pr\u00e9cise le Conseil d\u2019\u00c9tat. Il en va de m\u00eame pour la d\u00e9cision implicite ou explicite de rejet oppos\u00e9e \u00e0 une demande d\u2019annulation formul\u00e9e par une association<span class=\"footnote_referrer\"><a tabindex=\"0\" role=\"button\"><sup id=\"footnote_plugin_tooltip_901105038_1_28\" class=\"footnote_plugin_tooltip_text\">[28]<\/sup><\/a><\/span>.<\/p>\n<p>Ce d\u00e9cret doit obligatoirement \u00eatre motiv\u00e9 en application des dispositions des articles L. 211-2 et suivants du code des relations entre le public et l\u2019administration<span class=\"footnote_referrer\"><a tabindex=\"0\" role=\"button\"><sup id=\"footnote_plugin_tooltip_901105038_1_29\" class=\"footnote_plugin_tooltip_text\">[29]<\/sup><\/a><\/span>\u00a0et la dissolution ne pourra intervenir qu\u2019au terme d\u2019une proc\u00e9dure contradictoire<span class=\"footnote_referrer\"><a tabindex=\"0\" role=\"button\"><sup id=\"footnote_plugin_tooltip_901105038_1_30\" class=\"footnote_plugin_tooltip_text\">[30]<\/sup><\/a><\/span>. \u00c0 cette occasion, le juge du fond devra s\u2019attacher \u00e0 v\u00e9rifier la l\u00e9galit\u00e9 de forme<span class=\"footnote_referrer\"><a tabindex=\"0\" role=\"button\"><sup id=\"footnote_plugin_tooltip_901105038_1_31\" class=\"footnote_plugin_tooltip_text\">[31]<\/sup><\/a><\/span>\u00a0et de fond du d\u00e9cret de dissolution. Il veillera \u00e9galement au respect du principe de proportionnalit\u00e9 en mati\u00e8re de sanction<span class=\"footnote_referrer\"><a tabindex=\"0\" role=\"button\"><sup id=\"footnote_plugin_tooltip_901105038_1_32\" class=\"footnote_plugin_tooltip_text\">[32]<\/sup><\/a><\/span>. En effet, \u00ab\u00a0la police ne [devant] pas\u00a0tirer sur les moineaux \u00e0 coups de canon\u00a0\u00bb<span class=\"footnote_referrer\"><a tabindex=\"0\" role=\"button\"><sup id=\"footnote_plugin_tooltip_901105038_1_33\" class=\"footnote_plugin_tooltip_text\">[33]<\/sup><\/a><\/span>, il appartiendra au juge administratif d\u2019envisager la dissolution administrative comme la peine envisageable la plus s\u00e9v\u00e8re, alors m\u00eame que les sanctions administratives susceptibles d\u2019\u00eatre prises \u00e0 l\u2019encontre de l\u2019association peuvent prendre d\u2019autres formes\u00a0: peines p\u00e9cuniaires, peines privatives de droits (suspension, retrait d\u2019autorisation ou d\u2019agr\u00e9ment, fermeture d\u2019\u00e9tablissement, interdiction d\u2019exercer certaines professions\u2026) ou encore sanctions morales (publicit\u00e9 donn\u00e9e \u00e0 une mesure de sanction par exemple).<\/p>\n<p>Le juge des r\u00e9f\u00e9r\u00e9s peut \u00e9galement \u00eatre saisi d\u2019une demande visant \u00e0 suspendre l\u2019ex\u00e9cution du d\u00e9cret portant dissolution dans l\u2019attente de la d\u00e9cision au fond que le juge administratif sera amen\u00e9 \u00e0 prononcer.
